No Objection Certificate- What is it and how do you get it?

Radhika is a computer programmer who lives and works in Gurgugram. Recently, she received a job in Bengaluru and is now planning to move. Among her belongings is a scooty, which she would need to travel in the new city. But before she can get her scooty transferred to Bengaluru, she needs to obtain a No Objection Certificate (NOC) for her two-wheeler. The Regional Transport Office (RTO) where the scooty is registered issues this document. Hundreds of people like Radhika seek to transfer or even sell their two-wheeler at some point or another. If you are one among them, here is a guide to understanding what is NOC and its application process.

NOC for interstate two-wheeler registration transfer

No objection certificate (NOC) is a document issued by the RTO in which a two-wheeler is registered. It states that the current RTO has no issues with the two-wheeler registration being transferred to a new RTO. Essentially, by this document, the source RTO is confirming to the destination RTO that the bike or scooter does not have any tax dues pending on it. It also confirms that there are no outstanding challans or  Department Statutory Action (DSA)  penalties either, which may restrict the two-wheeler from being transferred. In this format, the source RTO gives an all-clear to the destination RTO that the two-wheeler  is free from any action needed from their side and the new RTO can trust the two-wheeler being transferred to be free from any legal encumbrance.

Who can obtain a NOC?

A person who is the owner of the bike or scooter can apply for the NOC from the original RTO office. In case of the death of the person who owns the vehicle, their  legal heirs or successors  in the will can also apply for two-wheeler transfer NOC if they are not resident in the source state. Such heirs will need to submit an inheritance or succession proof before a NOC can be issued to them.

Why obtain a NOC for two-wheeler?

If you are planning to buy a two-wheeler from any other state, you can be assured that the two-wheeler you are buying is free from any court case or pending challans. This means that you will not have to chase the seller for any pending cases or challans that may come up later.

Documents required to apply for a NOC

• CMV Form 27 and 28, which are the application forms for no objection and grant of certificate in triplicate

• Original and copies of Registration Certificate (RC)

• Valid copy of bike insurance certificate

• Valid pollution under control certificate (PUCC) for the vehicle

• Pencil print of the chassis number of the vehicle

• Valid identity proof and address proof of owner

• Recent photos of two-wheeler owner

• CMV Form 31 if the original owner has passed away and two-wheeler is transferred to successors, this is as per  Rule 56 of Motor Two-wheeler1989

Process for getting the NOC

The following steps need to be followed for getting NOC-

• Obtain the required documents and copies thereof and fill the application form

• Visit the RTO where the two-wheeler is originally registered

• Submit the form and all required documents to the concerned officer

• Pay the fees for getting NOC and submit the receipt with the form if needed

Upon submission of the application, the RTO officer will intimate the traffic department and police to check if there are any pending challans on the two-wheeler or if the two-wheeler has been involved in any criminal case. Once the police departments have given all-clear from their side, the RTO will issue the NOC in three to four working days.

Conclusion

Remember that interstate bike registration transfer cannot be done without NOC. If you like Radhika want to move your bike from one state to another or if you are selling the bike to a person from another state, it is your responsibility to get an NOC. Similarly, for inter-state sales of  two-wheelers like scooters or motorcycles, it is best for both the buyer and seller to keep an extra copy of NOC with them even after submitting registration transfer application for future safety against previously unknown matters.
